Registered owners on real estate do not even have the right to be legally notified in writing of any changes on title. Yes, in secret is legal! 2019 IT IS STILL LEGAL! . Woman loses life savings renovating properties she does not even sole own? Why? Secret filing!
True story: That woman was my mother, died with a broken heart. She worked like a peasant all her life, stayed in an abusive marriage with a violent husband because of her religious beliefs. Renovated properties, losing her life savings she not solely own because my father "in secret" severed joint tenancy several years before he died. Our laws have not one word, not one paragraph of protection for registered owners. Secret filing is legal and registered owners have no rights what so ever to any changes to their title on their homes and income properties!? She did not discover the severance which meant she did not even own the matrimonial home until 18 years after my father died.. more on that later. Secret filing is an abomination criminal law that was brought to Canada by the British to steal properties from our native people and the French settlers! CTV April 4, 2018: UPDATE - Reported that a couple, "GNANAMALAR SHANMUGAN" & her husband, lost their Brampton, Ontario, home to mortgage fraud & title theft! Samantha Brookes, CEO Mortgages of Canada, claimed that this is common in Canada! CTV news online: Recently, police charged 4 men in a sophisticated $17 million mortgage fraud investigation began in 2013 called, PROJECT BRIDLE PATH, which is a multi-million mansion district of Toronto, Ontario. The CTV article does not say if the victims lost their homes too? Not bloody likely. Only the poor get that kind of Canadian injustice. What they did not discuss was that this is a direct result of "SECRET FILING IS LEGAL IN CANADA & BANNED IN EVERY OTHER COUNTRY BUT CANADA! They went on to say title insurance would have protected them. Absolutely not true!! There are hundreds of thousands of other cases that you never even hear about and it has been going on for hundreds of years. Banning secret filing & getting Canadian laws into the 21st Century democratic rules of making it law that;
BEFORE ANY NAME OR CHANGES ARE ALLOWED TO BE REGISTERED OR PUT ON TITLE ON REAL PROPERTY - ALL REGISTERED OWNERS MUST FIRST BE NOTIFIED IN WRITING & CONSENT OBTAINED IN WRITING! That is the law in Saskatchewan, and it is the only province that makes such fraud impossible.

Alberta & Manitoba banned secret filling but there is no protection for spousal rights. Only Saskatchewan demands spousal consent or file in court a separation or divorce otherwise the spouse has the rights to their home when a spouse dies, unless separation or divorce. Secret filing is a law designed by the Romans 2,000 years ago for the sole purpose of stealing your properties, commit fraud, stealing estate incomes. Saskatchewan is the only province that makes it impossible to such heinous crimes.
Why is secret filing banned in every country but Canada? Because our government corrupt system is not a true democracy and making too much money at your expense! All stories that follow are true! A Canadian veteran of 3 wars at 92 discovered his nephew had title to his home. I took him to my lawyer to find out how and why? He had unknowingly signed what he thought was a will leaving his home to his nephew after his death, but what the nephew had done was had him sign a transfer of title, then had the transfer filed in secret. This is of course fraud but a fight in court would cost years and perhaps $!00,000.00 - and fraud can't be proved since filing in secret is legal. Instead I got the Veterans Association to help him, they moved him into a nursing residence and he lost his home.
An Ontario millionaire's heirs lost their inheritance from their father and never understood why? It was because Ontario law allows for an executor to take title to all properties after you die. His executor transferred title in secret, sold the properties and left for parts unknown with the money. Police refuse to even investigate since transferring title in secret is legal! But did not bother to even tell the heirs that. I happen to meet a member of his family several years later, who told me the story wondering how did the executor do it? I explained to him how. He decided not to tell the heirs not wanting to upset them since there was nothing they could do anyhow.
A Hamilton man in his 30's got a contract job 1975, out of town, luckily, long before the market boom. He gave his house key to a lady friend to check on it while away. When he returned 4 years later, discovered she had changed the locks, moved in, had registered her name on title to his home in secret.
His lawyer advised him that the court costs and years of fighting her would exceed the value so he was forced to pay her half the current market value to get her name off title and regain possession of his home.
Fortunately, he had made more than enough money while away, he could afford to do that. Most victims are not so lucky to have such cash available.
A gentle elderly Sudbury widower for many years, lonely, developed a friendship with a woman for someone to have dinner with, go to movies with. Not a lover but simply a companionship friend who did not live with him. In his will he left his home to his son, a construction labourer, married with 3 young children, renting unable to afford a home. When the gentle man died, his son's lawyer discovered the woman was on title, filed in secret, with no permission, or notice to his father. The lawyer demanded $50,000.00 cash up front or it was not worth his time to fight her in court. The son just a poor uneducated worker, not having that kind of money was forced to abandon it & continues to live in a rental unit to this day. Frankly, that lawyer was a mercenary jerk! He could have at least filed for his father's half title, filed for "PARTITION TO SELL" which would not have cost very much and get him at least half the value. Instead he got nothing.
A middle aged single mother, who worked 2 jobs to raise her children, purchased a home paid the mortgage off after 30 years. With her children all on their own, working, she began to date a charming man. he put his name in secret on title to her home, put on it a mortgage above its' market value with 3 separate financial lenders also in secret. then he quickly disappeared. She lost her home and is now living in subsidized house, still cleaning houses at 75 to survive.
Another woman now in her 60's, a widower, lost her home to her son. He also in secret got his name on title to her home (as did my brother to my mother) ran up debts, forced to sell to pay off the debts, she too wound up in abject poverty. Unable to afford even a seniors subsidized residency. When she turned 65 she moved into a depressing basement apartment. Saving her money, at 70 she moved into another main floor apartment were she is grateful she is not trapped in a drug infested subsidized complex like her girlfriend is.
So many victims of secret filing stories are never told. Their plight is trapped in a corrupt court system designed for criminals, makes them victims of fraud, embezzlement of estate funds, all made legal by secret filing. Those that wind up in court are never made public because our media just ignores it completely.

No matter how long you are married you can lose your home! You buy your home in joint tenancy which means if one dies the other automatically has the home. Of course that is how it should be. The executor had pocketed the rent income and not paid the taxes for several years also in secret! A forced sale in duress was well below market value, mother & I lost our home. Saskatchewan is the only province in Canada, law requires consent to severe joint tenancy on the matrimonial home. A separation or divorce is settled in court. Any changes on title to any property, requires notice in writing to all registered owners. ONTARIO LAWS ON REAL PROPERTY CAUSED FRAUD & CONTRIBUTED TO CRIMINAL BEHAVIOUR. The following are the events that prove this statement. I need help to complete and file a multi-million dollar affidavit against the Ontario Government. Filing for no compensation was my foolish mistake, left me homeless and devoid of any media or public support. I am a severely handicapped person 76 with Parkinsonism Disease (in effect I live with dying) and my mother Rollande Upchan, 2015 lost her home, 525 St. Raphael St., Sudbury, Ontario, died at 98 (not from old age but a broken heart) and I became homeless 2017 as a direct result that Ontario law allows for severance of joint tenancy IN SECRET without consent, anyone can put their name on your property without your knowledge, & Executors of estates have the right in Ontario, to take title to all your properties IN SECRET, when you die.
My father severed joint tenancy 1996 IN SECRET without mom or my knowledge. 2008 mom and I filed for joint tenancy on the matrimonial 4 bedroom home 525 St. Raphael St and received a lawyer's letter confirmed we were now the owners. 2009 however, IN SECRET, my brother had a lawyer, Serge Treherne filed without a search of title, a transmission giving my brother legal ownership title to all our properties including our matrimonial home without our knowledge or consent. Therefore my brother as father's executor took title to the matrimonial home in violation of the family law act IN SECRET, terrorized my mother threatening her to have her evicted if she did not allow him to manage all the income properties and in effect I being sick, mom terrified, we allowed him to manage but not to steal title. Instead he committed income tax fraud, IN SECRET embezzled the estate funds IN SECRET and did not pay the taxes IN SECRET from 2010 also without our knowledge as he had the City tax dept send all bills directly to his home not in Sudbury. Previously 2008 I sold a 4 bedroom home in Wasaga Beach I owned with mother to bail her out of abject poverty giving up my home and lifestyle to live with, take care of and protect my mother best I could. I knew my brother was stealing funds from the estate but did not know how he got so much power. My lawyer David Innes had no knowledge of what my brother was doing either. So mom and I were held hostage by my brother until June 2014 when we received from the City of Sudbury NOTICE OF PUBLIC AUCTION OF OUR HOME AND PROPERTIES. I scrambled to use up my savings and pay the taxes on the matrimonial home (which I thought mom and I owned) back taxes on a vacant lot mom and I owned (used as a parking lot for the 11 plex 507 St. Raphael & duplex 558 Howey Dr.) all properties were running adjacent to each other. I paid $15,000.00 to Richard Pharand a lawyer to have my brother removed as executor and get the properties on the market to sell before the auction wiped us out. He did nothing but stall us for several months - facing public auction I panicked hired Trent Falldien and solicited a buyer that turned out to be a conman. We were forced to sell well below market value and mom so devastated by the betrayal of her beloved son.. took a heart attack. I developed a tumour and was paralyzed many months unable to walk, speak coherently, read or write. In that condition we were simple robbed of everything. I demanded all the money go into court as I fully intended to fight the law and not go after my brother until I had a completed Affidavit filed under section 7 Charter or Rights. May 2016 some of the sale was awarded by the court to me and mother, about $200,000.00 and I asked Mr. Falldien due to my Parkinsonism attacks, to protect me and mom now terminal, we both being so vulnerable to theft (in an attack I cannot function, excruciating pain, walk, talk, rear or write semi-catatonic at the left of a five year old child quite helpless) I asked Trent to keep the money in his trust account be he refused. Shortly after Doug MacIsaac my boyfriend of 32 years brother, tricked mom and me, lying saying the sale had gone into the hands of the bank and we were going to be evicted if I did not give him our money. He had lied claiming to be the buyer but had flipped the sale of our home and land to someone else. He tricked me to sell to him at a fraction of the value of our home and land so i could raise the money to pay Trent Falldien. Mr. Falldien was not a real estate lawyer and saw nothing wrong in the sale. Had I been well I am trained as an real estate investment consultant and would have cancelled the sale. Sick however, mom terminal, we were helpless as beached whales. To make a long horrendous 3 year story short, Mom and I made arrangements to become tenants in our home, too sick to move. Our agreement was when mom died, I would leave so the new owner Elio Brutto could renovate. Doug MacIsaac had tricked him also and he was bleeding money and the renovations were necessary to recoup his losses. Between my Parkinsonism and mother dying all I cared about was getting the laws changed and secret filing banned. So I decided to use my life savings $70,000.00 to pay Trent Falldien to help me in my cause. Mom died Feb 18, 2017 shortly after her 98th birthday having had 3 heart attacks back to back - and keeping her alive best I could and deal with my disease plus working night and day to research government laws etc. I have lived with such brutality you cannot imagine a direct result of the snow balling effects of secret filing being legal. Finally June 2017 I objected the May Affidavit Trent Falldien filed as it was missing crucial evidence and agreed to pay him an additional $10,000. to get the documented evidence I felt needed to win my case in court. I was very foolish, thinking if I filed for no compensation I could win instead had I filed a multi-million dollar law suit I would now be world famous. Instead, I am just another homeless stupid old woman, no cares about. I begged media to help me for over 17 years and they continue to refuse. I begged every Member of Provincial Parliament, Premier of Ontario, Prime Minister, every Advocacy group in Canada coast to coast - all rejected to help. Running out of money, Trent still had not filed a completed Affidavit by August 30 and he wanted more money - I got upset and sent him an email angry not with him but with the government forcing me into being homeless, paying all this money fighting all by myself with no media or public support, begging him to complete the Affidavit with the new evidence from the 3 provinces and file as quickly as possible.
Trent Falldien took offence to my being upset with what the government was costing me both in health and money and terminated me. He has all the documented proof secret filing was banned in Manitoba 1988, Saskatchewan 1989, Alberta 1985, England 1925, New South Wales etc. I paid my life savings to Trent Falldien over a 2 year period to complete this Affidavit under Section 7 Charter of Rights and he refused despite i already paid him for it and he has all the evidence required by the Supreme Court of Canada. From the day I hired Trent he is a young lawyer, and promised me that he could deal with constitutional violations of rights as this was his thesis as a law student. Instead, knowing he was making me homeless, sabotaging both my cases, one the government to get secret filing banned, two fraud against my brother - he callously, terminated me. Seems he has no compassion for my disabilities, or being handicapped, living in agonizing paralyzing attacks Parkinsonism Disease, homeless and robbed of over $500,000.00, grieving my dead mother. the terrorizing abuse of my brother holding us hostage 15 years, losing our home and money, I was terminated. He put my file into a box and left me with nothing, destroying my life's work.
Originally Trent has assured me the cost to file the Affidavit would only be $40,000.00 I gave him $60,000. plus an additional $10,000. to fight a pro-bono case against police brutality. I admit when I got his bill for another $10,000. I had a nervous breakdown. My Affidavit was incomplete and worthless, but I was not even upset with him. I paid it gladly but just wanted to stop bleeding my dry and get the job done. I was upset with the government. Don't I have a right to be upset? He accused me of accusing him of misconduct. I attach a copy of my email of Aug 2017 and you can clearly see that I did no such thing. Up to this point both mother and I worshipped Trent as our hero. And I fully believed he had done an amazing job. I helped Trent get into Real Estate law and trained him so he could make more money. I suggested he file a multi-million dollar lawsuit and gave him the money to do it - against the Sudbury Police and get media publicity which he did, CBC covered the story. He got famous and has a thriving business because of me. Yet, he discarded me, and my life's work like I was just trash.??!!
I don't care about the money I lost. I just don't want to die with such a law as filing in secret to continue to any other person what it has done to me and my mother. I am not fighting our government for money but for justice for all. Even if I could refile for millions and the government award gave me money I would donate it to an advocacy group to fight for human rights for seniors being made homeless. I am fighting only to change the laws in Canada - get all secret filing banned coast to coast. I just want justice and stop Canadians but especially seniors being the most vulnerable, from losing their homes because our laws contribute to fraud and criminal behaviour leaving us completely defenceless. My father was an unscrupulous violent monster who beat my mother up during their 61 years of marriage, he died Jan 2000. Tens of thousands of victims forced to fight in court their own case, yet no one challenged the law being in violation of basic human rights. My brother stole our home and property rights, committed fraud and SECRET FILING made it possible. The snow balling effect is astronomical. And too lengthy to go into but I have other cases documented. 2005: Over 100 people in Ontario wound up with fraudulent mortgages on their homes, filed IN SECRET, that they did not negotiate, that were fraud, filed IN SECRET. In my case it killed my mother, made me vulnerable to a crook who tricked me into selling for a fraction of of its' worth, then the same crook tricked us out of the money we did get from the sale. Instead I became homeless but my boyfriend of 32 years rescued me, we gave away all my furniture to St. Vincent De Paul and Dan gave away his gym to make room for my research files and gave me his bedroom.
August 31, 2017: I paid the additional $10,000.00 to Trent Falldien to get the document proof that Alberta banned secret filing 1985, Saskatchewan 1989 has by far the best laws, not only is secret filing banned but no severance of joint tenancy on the matrimonial home is allowed without consent and proof of identity of spousal consent, making fraud almost impossible. Tent never sent me a copy, instead he closed my file and terminated me. I willingly paid him $70,000.00 believing his promise he would take me through to the Supreme Court and he would help me get media and we would make history. In fact we worked side by side, hours at a time, day after day, month after month 2 years and if he had kept his word - we would have won. With the media publicity even if we had lost we would have won, as the publicity alone would have forced the government to ban secret filing. Doing anything less would have been too embarrassing for any political party. Instead, Trent callously sent me an email terminating me destroying my life. I was so devastated I tried to kill myself. Trent robbed me of the only thing I had left to live for and it was in honour of my dead mother that I fought. He knew what it meant to me and he simply did not care. My case to get secret filing banned was sabotaged and I was destroyed. Dan stopped me from killing myself - had I been alone I would have, there is no doubt about that. I spent weeks sobbing, hysterical, begging Trent to do the job I paid him for. He refused. I don't have either the health or money to start all over again. What caused Trent Falldien to decide to fire a 76 year old handicapped homeless woman who just lost her mother, grieving the lost home and all her money - what made him think this was fair treatment? Did he do it knowing the damage he was doing and that such an action would destroy me? Yes, of course he did. So what do I do now? I live only to protect Canadians from going through what my mother went through and the suffering I am enduring. It is what makes my brutal torture worth it. Without it yes, I would rather die.
How many Canadians were already a victim of fraud, property theft, due to SECRET filing is my guess tens of thousands in Ontario. Tens times that across Canada over the past 100 years not including our native peoples. Yet their tragedy had never been addressed by our current corrupt court system. if secret filing is allowed to continue it never will be. Secret filing is a system so evil that if you hired the Mafia to design a system to make it legal for fraud, property theft rights, criminal behaviour, embezzlement of estate funds, you could not have created a better system to promote making crime legal. Only Saskatchewan requires spousal consent and full protection, notice itself is not good enough.
May 2017 Trent Falldien put me off delaying since 2015 and I began to pressure him to file. I was becoming afraid of such delays would cost me my cases. May 2017 he then filed an incomplete Affidavit and we went to work to get all the evidence which was not in the Affidavit. June he want to refile again incomplete but I agreed to pay more money and research to get the 3 provinces as crucial evidence. He had done nothing to help me get media or any advocacy group to help our case. I did not even question it, I trusted him that much. But clearly he was not being fair to me even then, but I suspected nothing. I trusted him with my life. Getting the evidence from Alberta turned out to be very costly, long distances phone calls, hours and days on line researching government files etc. I did not expect to pay another $10,000.00 just for a few pieces of paper from Alberta but agree to pay it however; frightened that I could not afford $10,000. a month expenses. After paying it - instead of completing my Affidavit Trent did nothing, closed my file and terminated me August 31, 2017. At first confused in disbelief I begged his forgiveness despite having done nothing wrong. He then said okay in September but again did not complete the Affidavit or sent me my copies of the Alberta and Saskatchewan documented evidence that had cost me $10,000.00. He stalled me cancelling further appointment and did nothing. Suddenly October 24, 2017 he sent me by email another terminal letter this was being final. I fell apart and tried to kill myself and had a severe nervous breakdown, from which I still have not fully recovered.
Since then on reflection and having only $14,000.00 left to throw away.... I should have file for $18 Million against the Ontario Government. I would have gotten the media and public support and the government would have banned secret filing whether I won or not. If I could find a human rights lawyer I would gladly give them that $14,000.00. However, I do not believe Trent Falldien should get away with firing me. He should be forced to complete the affidavit I paid him for and hired him for in the first place back in 2015. I believe he is in breach of contract and should be liable and forced to provide a completed Affidavit with all the documented evidence that took me 4 years to gather, plus the provincial evidence from Alberta, Saskatchewan and Manitoba.
I now believe that a new Affidavit for $18 Million must be filed against the Ontario Government, which would force the media to expose' the truth. I still want nothing in return except to get secret filing banned. I want the world to know that I do what I do not for money but for justice. I have no lawyer, so my case of fraud against my brother Trent Falldien has also sabotaged. His behaviour towards me is despicable and he dishonours my mother and my life in so treating us this way. My case is proven and it would have made history. I am reeling in despair desperately need help to right is injustice. SECRET FILING KILLED MY MOTHER AND DESTROYED MY LIFE.
I truly believe that if Trent Falldien is forced to complete the job I paid him for by the Law Society of Ontario, the evidence has been proven beyond a reasonable doubt that SECRET filing on real property contribute to fraud, property theft and criminal behaviour. Unlike Alberta whose researching its government documents was so difficult it cost me $10,000.00 and the loyalty of a lawyer Trent Falldien whom I had worshipped as a human rights hero - Saskatchewan and Manitoba cost me nothing. Google sent me Saskatchewan 1989 Homestead act. And Manitoba librarian in their government sent me a copy direct to me for free. I guess some Canadians do have a heart.

December 21, 2018 The photos above are the apartment Dan has lived in for 34 years ( found this apartment for him and lived with him part time when too sick to take care of myself.) 2017 I moved what I could salvage in with him (mom lost our home story below) due to Trent Faldien, my lawyer made me homeless & I lost my case against the government of Ontario criminal laws because of his treachery. So Doug MacIsaac who owned this building and 30 others who committed fraud and will never go to jail... because of his gambling lost all the properties and our building plus 12 others were foreclosed by CAISSE POPULAIRE over a year ago - these photos are from last spring when Caisse negligence refused to repair the outside of the building's falling bricks by installing aluminum siding to stop them falling. We complained to the City of Sudbury, and they tried to force Caisse to make the repairs. (sample below) Well Caisse refused and the situation got worse so the City hired a contractor to get rid of the bricks that were unstable and put up scaffolding to protect us. 3 tenants moved out with the help of Sudbury subsidized housing but 3 are left that do not qualify. I am in bed 6 months almost every day, paralyzing attacks and in that condition - we got served with a 7 day EVICTION NOTICE! THAT IS OUR PUNISHMENT FOR COMPLAINING AGAINST CAISSE POPULAIRE! They are claiming they need all apartments empty to renovate but the apartments were renovated with plumbing, heat, hydro several years ago & nothing is wrong with the apartments (a bit of damage to 2 empty apartments from water by a squatting tenant no gone). But no apartment needs renovating as all plumbing, kitchen & bathrooms, hydro were renovated by the previous owner Doug MacIsaac. Only the OUTSIDE OF THE BUILDING REQUIRES REPAIRS. However; laws in Canada allow for bogus renovation claims to get rid of tenants including seniors who have lived here for 34 years; namely us. Caisse Populaire is not just negligent they have devalued the buildings, which if I was a shareholder I would not be pleased. Caisse Populaire is a monstrous inhumane company that no one should deal with unless they like dealing with sociopaths. Caisse Populaire was offered fair market value before the negligence but their management were so hard ball, un-cooperative (like my brother) to deal with that no investor in his right mind would pay $200,000. over market value so we wound up with Caisse Populaire as owners who are now taking legal action to evict us in the middle of winter! Caisse Populaire had the buildings under power of sale for 2 years and did nothing. Welcome to Canada - the land of laws that are so criminal they are banned in every other country but Canada! And where every member of parliament both federal and provincial has been informed, including all political party leaders & all media and no one gives a damn! yes, WELCOME TO CANADA!!
December 21, 2018; photo of me sick with Parkinsonism in bed 80% of time. Trauma of events and now eviction is more than I can bear. In this condition I have to find a new apartment, we can afford, cannot climb stairs, allergies etc. My life is just so brutally torturous it is not worth living, but I keep trying for the sake of the children who will suffer as I unlike somehow we get democratic laws in this country, an apathetic cold hearted society gone mad with greed.
